GENERAL TERMS AND CONDITIONS OF THE PAYSAFE GLOBAL HACKATHON 2018

 

I. ORGANIZER

The Paysafe Global Hackathon 2018 – a software development competition ("Hackathon") will be organized by Paysafe Holdings UK Ltd incorporated and registered in England with company number 03202517 whose registered office is at: Floor 27, 25 Canada Square, London, England, E14 5LQ ("Organizer").

 

II. ELIGIBLE PARTICIPANTS

To participate you shall be at least 18 years old and shall have submitted a completed participant declaration form. If you are successful in the first round of the competition you need to be able to physically present yourself at the onsite event at one of the following five addresses on Saturday 27th October 2018, where Organizer will not cover for any travel expenses:

Sofia: 90 Tzarigradsko Shosse blvd., 1784, Sofia, Bulgaria, Capital Fort building, New York Hall

Vienna: Impact Hub Vienna, Lindengasse 56, 1070 Vienna, Austria

Calgary: The Calgary Herald, 215 16th Street SE, Calgary, Alberta, T2E 7P5

Montreal: Place Alexis Nihon – Tower 2, 3500 Boulevard de Maisonneuve O, Suite 660, Westmount, Quebec, H3Z 0A5

Hyderabad: T-Hub, IIIT-Hyderabad Campus, Gachibowli, Gachibowli, Hyderabad, Telangana 500032

Participants shall not be personally subject to or be citizens of a country that is under trade sanctions or other trade restrictions. Employees and service providers of the Paysafe group of companies are not allowed to participate as competitors in the Hackathon.

 

III. GLOBAL HACKATHON

Participation in the competition is free of charge.

Participants must register via the following website: paysafe.com/hackathon2018 from the 1st October 2018.   

The Hackathon will consist of two rounds of challenges consist of coding tasks. The first being an online challenge which will be the qualifying round for participants to attend the onsite 2nd round. The top 50 winners per each of the five locations from the online challenge will qualify for the multi-location onsite event at our 5 locations. All successful participants must be able to attend the onsite event and shall fill-in a participation declaration which shall take place before the competition start on Saturday 27th October 2018.

The online and onsite challenges will be focused around the two following areas:

  1. Graph Theory
  2. Dynamic Programming

 

Participants will compete in the online challenge as individuals. The online challenge starts on 8th October 2018 at 08:00 am BST in each location and ends on 20th October 2018 at 07:00pm BST.

The individual prizes for the online challenge will be:

1st Place: $3,000

2nd Place: $2,000

3rd Place: $1,000

The winners from the online challenge will be decided by Codilty, using the leader board and extra filters. Any attempts of cheating can be detected and disqualifies you from the challenge.

The onsite challenge will take place on the 27th October 2018 and will start 8:30am local time and end at 8pm local time.

At the onsite event participants can only compete individually. Each participant shall bring his/her own devices (laptop, computer mouse, etc.).

The individual prizes for the onsite event will be:

1st place local winning individual: $5,000

1st place global winning individual: $20,000

The local onsite winners will be decided by the jury in each location and announced at the end of the competition day. The local juries will decide the global winner jointly and this will be communicated to the individual the week commencing 29th October 2018.

The work product must be entirely original work and must not contain anything that is or may be illegal or be in any way improper (including, but not limited to, hateful, defamatory, obscene, indecent or be in any other way objectionable by a reasonable person). The work product must not use any patent, copyright, trademark or other proprietary right except as permitted under applicable laws.

Each participant hereby authorizes and licenses the Organizer and its employees and contractors to inspect, reverse engineer and evaluate the work product with which the individuals participate in the Hackathon without any compensation. Organizer acknowledges that it will not use any parts of the work product or the work product as a whole for any other purposes, except for evaluation of the competing work products and selection of the winners. Paysafe will be using a third-party supplier named Codility to create the custom challenges. Any use of Codility’s platform is subject to the then current Codility’s Programmer Terms of Service. We would like to turn your attention to the fact that according to the said Terms of Service, you grant Codility “a worldwide, non-exclusive, royalty-free, sublicenseable, transferable and perpetual license to use, copy, reproduce, distribute, adapt, re-format, modify, publish, translate, license, sub-license, assign, transfer and otherwise exploit in any manner the User Content anywhere and in any form for the purposes of providing our Service or for any purpose in connection with the operation of our business.”, which essentially means that Codility can use any code you input into their systems. The Organizer shall not be responsible for any such use by Codility or be responsible for any matter relating to the usage of Codility’s platform and any and all disputes around the use of the Codility platform shall be settled between the participant and Codility directly. We recommend and advise you to read Codility’s Programmer Terms of Service in detail.

The final result will be based on the score, correctness, and performance of the submitted code. The time of completing the challenger and order of submissions may also be taken into consideration.

The prizes shall be transferred via wire transfer to a bank account specified by the winner after the announcement of the winners by the Organizer and the Organizer shall not take any responsibility for failure of the participant to avail the prize due to inaccurate information provided by the participant. The Organizer reserves the right to replace any winner if we discover that the winner is or was in breach of these general terms and conditions.

Prizes are non-exchangeable.

QUOTED PRIZES MIGHT BE TAXABLE IN YOUR JURISDICTION AND EACH WINNER WILL BE SOLELY RESPONSIBLE FOR COMPLYING WITH ANY AND ALL APPLICABLE FEDERAL, STATE, PROVINCIAL, LOCAL, OR OTHER STATUTES, REGULATIONS, AND OTHER LAWS AND FOR BEARING ANY PERSONAL INCOME, VAT, GST, WITHHOLDING TAXES, CUSTOMS DUTIES, OR OTHER TAXES, FEES, INSURANCE, SURCHARGES OR OTHER COSTS RELATING TO ANY REWARD. IF THE ORGANIZER IS OBLIGED TO WITHOLD TAXES UNDER THE APPLICABLE LAWS, THE ORGANIZER WILL DO SO WITHOUT ANY NOTICE. ORGANIZER WILL COOPERATE AND ISSUE ANY DOCUMENTS THAT MIGHT BE REQUIRED FOR TAX PURPOSES, BUT IT IS THE PARTICIPANT’S OBLIGATION TO REQUEST AND COLLECT SUCH DOCUMENTS.

IV. OBLIGATIONS OF PARTICIPANTS

Each participant undertakes to comply with all applicable laws.

Individual participants will not submit any work product or content that is copyright protected, patented or represent any sort of a trade secret or otherwise is subject to any other third-party rights, including intellectual property rights or other proprietary rights, privacy and publicity rights or is subject to confidentiality, unless the participant is the owner of such rights or has permission from the rightful owner or owners to use and present the content to the public for the purposes of participation in the Hackathon.

The work product and all parts thereof must not contain any viruses, malware, Trojan horses, worms, or other disabling devices or harmful code.

 

V. LIMITATION OF LIABILITY

THE ORGANIZER, ITS GROUP COMPANIES, AGENTS OR DISTRIBUTORS WILL NOT IN ANY CIRCUMSTANCES BE RESPONSIBLE OR LIABLE TO COMPENSATE WINNERS OR PARTICIPANTS OR ACCEPT ANY LIABILITY FOR ANY LOSS, DAMAGE, PERSONAL INJURY OR DEATH OCCURRING AS A RESULT OF PARTICIPATION IN THE HACKATHON OR TAKING UP A PRIZE, EXCEPT WHERE SUCH IS CAUSED BY THE ORGANIZER’S GROSS NEGLIGENCE, FRAUD OR WILFUL MISCONDUCT, ITS GROUP COMPANIES, AGENTS OR DISTRIBUTORS OR THAT OF ITS EMPLOYEES.

THE ORGANIZER DOES NOT ACCEPT ANY RESPONSIBILITY FOR ENTRIES AND WORK PRODUCTS NOT SUCCESSFULLY COMPLETED OR REGISTERED DUE TO A TECHNICAL FAULT, TECHNICAL MALFUNCTION, COMPUTER HARDWARE OR A SOFTWARE FAILURE, SATELLITE, NETWORK OR SERVER FAILURE OF ANY KIND.

THE ORGANIZER, ITS GROUP COMPANIES, AGENTS OR DISTRIBUTORS WILL NOT BE RESPONSIBLE FOR:

  • ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY PARTICIPANTS, PRINTING ERRORS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILISED IN THE HACKATHON;
  • TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, OR DISCONNECTIONS IN PHONE LINES OR NETWORK HARDWARE OR SOFTWARE;
  • UNAUTHORISED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE HACKATHON;
  • ANY FRAUDULENT ACTIVITY, ERROR, OMISSION, ALTERATION, TAMPERING, UNAUTHORIZED DATA HACKING, DELETION, THEFT, DESTRUCTION, VIRUS ATTACK OR OTHERWISE CAUSED BY ANY OF THE PARTICIPANTS OR THEIR DATA, ENTRIES OR WORK PRODUCTS.
  • LOSS OR CORRUPTION OF DATA, ENTRIES OR WORK PRODUCTS;
  • TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE HACKATHON OR THE PROCESSING OF ENTRIES AND WORK PRODUCTS;
  • ANY DELAY IN PERFORMING OR PARTIAL OR TOTAL FAILURE TO PERFORM ANY OF THEIR OBLIGATIONS (INCLUDING BUT NOT LIMITED TO DELAYS, CHANGES, CANCELLATIONS, DIVERSIONS, HOWSOEVER CAUSED) UNDER THESE TERMS AND CONDITIONS CAUSED BY CIRCUMSTANCES (INCLUDING BUT NOT LIMITED TO FORCE MAJEURE EVENTS) BEYOND THE REASONABLE CONTROL OF THE ORGANIZER, ITS GROUP COMPANIES, AGENTS OR DISTRIBUTORS; OR;
  • ANY INABILITY OF THE PARTICIPANT TO PARTICIPATE IN HACKATHON, OR THE USE, MISUSE OR INABILITY TO USE THE PRIZE OR ANY PORTION THEREOF; OR
  • ANY DAMAGE CAUSED BY CODILITY OR USE OF THEIR PLATFORM.

 

VI. PERSONAL DATA

The processing of your personal data (for Hyderabad participants this also includes but is not limited to personal information or sensitive personal data or information, if any, as each such term is defined under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011) is governed by the Paysafe Group Privacy Policy, available on https://www.paysafe.com/legal-and-compliance/privacy-policy/. If you are a prize winner, additional information may be required to verify compliance with these general terms and conditions. The winners may also be required to provide the Organizer with their specific personal identification information for tax purposes and compliance with the law.

 

VII. GENERAL

Even if not expressly confirmed in writing, participation in the Hackathon means that each participant has accepted these terms and conditions. Participants must accept those terms and conditions prior to entering the online challenge.

The Organizer reserves the right to remove you from the Hackathon where we have reason to believe that you have breached or tried to breach these general terms and conditions or attempted to circumvent any of our security or operational procedures.

All decisions of the Organizer are final and binding.

The Organizer reserves the right to hold void, suspend, cancel, or amend the whole Hackathon where it becomes necessary to do so at any time without prior notice.

If any part of these general terms and conditions is found by a court of competent jurisdiction to be invalid, unlawful or unenforceable then such part shall be severed from the remainder, which shall continue to be valid and enforceable to the fullest extent permitted by law. The Hackathon shall be void where and if prohibited by applicable laws.

All issues and questions concerning the construction, validity, interpretation and enforceability of these general terms and conditions, or the rights and obligations of the participant and Organizer, in connection with the Hackathon shall be governed by, and construed in accordance with the laws of England and Wales, subject to your local mandatory rights.
